EU Commission ends rule of law proceedings against Poland after six years

The European Union Fee issued a statement Monday saying they’ll finish six years of rule of regulation proceedings introduced towards Poland. President of the Fee Ursula von der Leyen congratulated the Polish Prime Minister, Donald Tusk, in what she known as a fruits of Poland’s diligent work and unwavering dedication to reform.

The Fee initiated proceedings underneath Article 7 of the European Union Treaty towards Poland in 2017, which offers mechanisms to deal with violations of EU values by member states. The Article 7 process includes a number of levels, together with an acknowledgment of the breaches inside a state, recognition of the intense nature of the breach from all different governments and, lastly, a vote on sanctions. The process was initiated towards Poland in 2017,when it was underneath the Regulation and Justice (PiS) authorities. The PiS authorities had introduced in various reforms, together with restructuring of the courts, ending the mandate of sitting judges prematurely and favouring appointees that have been pleasant to the ruling celebration. This led to allegations that the PiS have been appearing in an illegal method, and the EU Fee argued that the strikes compromised the separation of powers and entailed critical hindrances to the applying of EU regulation.

Since his election in 2023, Tusk has promised to revive authorized order and labored to enhance relations with Brussels, together with the creation of an “motion plan” of 9 proposed legal guidelines to reinstate judicial independence, in addition to commitments to adjust to rulings from the European Courtroom of Justice. By February, the EU Fee had unblocked €137 billion that had beforehand been denied to Poland.

The Polish authorities welcomed the announcement, with Minister of Justice Adam Bodnar stating on X that “Poland is [consequently] bringing again rule of regulation. We’re decided and dedicated to our widespread European [values].”

President Von der Leyen mentioned:

Right this moment, marks a brand new chapter for Poland … I congratulate Prime Minister Donald Tusk and his authorities on this necessary breakthrough. It’s the results of their arduous work and decided reform efforts. The continued restoration of the rule of regulation in Poland is nice for the Polish folks and for our Union as a complete. It’s a testomony to the resilience of the rule of regulation and democracy in Europe.
